1. Scope and Overview

This Privacy Policy explains how Jobba Trade Technologies, Inc. and its affiliates and brands, including Jobba and FCS (collectively, “JTT,” “we,” “us,” or “our”), collect, use, disclose, retain, and protect personal information in connection with our websites, hosted software applications, mobile applications, APIs, customer portals, support channels, implementation and training services, professional services, marketing activities, and any related products, features, content, communications, or tools that link to or reference this Privacy Policy (collectively, the “Services”). This Privacy Policy applies when JTT acts as a controller, business, or similar primary decision-maker under applicable privacy laws with respect to personal information collected for our own business purposes. When JTT processes personal information on behalf of a customer through the Services as a service provider, processor, or comparable role, that customer’s privacy notice and contract terms govern that processing, and JTT processes such data in accordance with those customer instructions and applicable agreements.

2. Categories of Information We Collect

We may collect the following categories of information, depending on how you interact with the Services: identifiers and contact details, such as name, email address, phone number, postal address, company name, job title, and account credentials; commercial and transaction information, such as subscription details, billing contacts, purchase history, service selections, and implementation records; customer relationship information, such as support requests, call recordings, meeting notes, survey responses, and communications; internet, application, and device information, such as IP address, browser type, device identifiers, operating system, mobile carrier, crash logs, usage logs, and interaction data; location-related information, such as approximate location derived from IP address and, where enabled, device or dispatch-related location information; professional and business information contained in account profiles, workflows, job records, dispatch records, proposals, invoices, media, attachments, and other materials submitted through the Services; and in limited cases sensitive information where necessary for legitimate business or service functions, such as payment-related information, government identifiers, or other information that requires heightened handling under applicable law.

3. Sources of Information

We collect personal information directly from you, automatically from your devices and use of the Services, from your employer or organization, from our customers and their authorized users, from referral partners and marketing sources, from service providers acting on our behalf, from integrated third-party services that you connect to the Services, and from publicly available or commercially available sources where permitted by law. If you provide personal information relating to another person, you represent that you have the authority to do so and to permit us to use that information as described in this Privacy Policy.

4. How We Use Personal Information

We use personal information to provide, operate, maintain, secure, support, improve, and personalize the Services; to create and manage accounts; to authenticate users; to process subscriptions, payments, renewals, and related transactions; to deliver implementation, training, onboarding, integration, consulting, and support services; to communicate with you about the Services, product updates, security notices, operational messages, and marketing where permitted by law; to monitor performance, troubleshoot issues, prevent fraud, enforce our agreements, and protect the rights, safety, and security of JTT, our customers, users, and others; to comply with legal obligations; and to develop analytics, reporting, automation, and product enhancements. Where permitted by law, we may also use personal information to market our own products and services, subject to applicable opt-out rights.

5. Customer Data and Service Provider Role

When customers use the Services to store, manage, or transmit information relating to their employees, contractors, end customers, leads, site contacts, schedules, dispatches, proposals, invoices, photos, recordings, or other operational records (“Customer Data”), JTT generally processes that information on the customer’s behalf under the applicable contract. In that context, the customer is responsible for determining the lawful basis for collection and use of Customer Data, providing any required notices, obtaining any required consents, honoring applicable rights requests, and ensuring that its use of the Services complies with applicable law. JTT will process Customer Data as necessary to provide, secure, support, and improve the Services, consistent with the applicable agreement, documented instructions, and law.

6. AI and Automated Features

The Services may include AI-enabled, machine learning, predictive, recommendation, summarization, workflow, or automation features (“AI Features”). JTT may use personal information, Customer Data, prompts, usage telemetry, feedback, and related content to provide and support AI Features, detect abuse, improve system quality, and maintain safety and security. Unless otherwise expressly agreed in writing, JTT may also use de-identified, aggregated, or otherwise non-identifying data derived from AI interactions and Service usage to improve its products, models, automation, analytics, and service quality. AI-generated outputs may be inaccurate or incomplete and should be reviewed by the responsible user before being relied on for operational, financial, legal, safety, or customer-facing decisions.

7. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, tags, SDKs, local storage, session replay tools, analytics tools, and similar technologies to operate the Services, remember preferences, authenticate users, analyze activity, improve performance, measure marketing effectiveness, and support security. Depending on your location and the applicable law, you may be able to manage cookie preferences through your browser settings, device settings, or a consent management tool we make available. Disabling certain technologies may affect the availability or functionality of parts of the Services.

8. How We Disclose Information

We may disclose personal information to our affiliates; to vendors, contractors, subprocessors, hosting providers, communications providers, payment processors, analytics providers, implementation partners, support providers, and other service providers that perform services on our behalf; to integrated third-party services at your direction; to professional advisors, auditors, insurers, and financing sources; in connection with a merger, acquisition, financing, reorganization, bankruptcy, or sale of assets; to comply with law, legal process, or governmental request; to protect rights, property, safety, and security; to investigate suspected fraud, abuse, or violations of our agreements; and with your consent or at your direction. We may also disclose de-identified, aggregated, and statistical information that does not reasonably identify an individual or a specific customer.

9. Marketing Communications and Customer Messaging

We may send administrative, transactional, service, and relationship messages related to accounts, subscriptions, security, billing, support, product changes, and other operational matters. Where permitted by law, we may also send marketing communications about JTT products, services, webinars, events, and related offerings, and recipients may opt out using the unsubscribe mechanism or by contacting us. If a customer uses the Services to send messages, notifications, or communications to its own customers, leads, employees, or other contacts, the customer is responsible for those communications, including obtaining any required consents, honoring opt-outs, and complying with applicable telemarketing, SMS, email, call recording, consumer protection, employment, and privacy laws.

10. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business records, comply with legal and contractual obligations, resolve disputes, enforce agreements, support security and fraud prevention, and preserve evidence. Retention periods vary based on the nature of the information, the context in which it was collected, applicable law, customer instructions, backup cycles, and operational necessity. When personal information is no longer reasonably necessary, we will delete, anonymize, or de-identify it, unless continued retention is required or permitted by law.

11. Security

JTT maintains administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, alteration, or disclosure. These measures may include access controls, role-based permissions, encryption in transit and at rest where appropriate, logging, monitoring, vulnerability management, backup processes, and personnel confidentiality obligations. No method of transmission or storage is completely secure, and JTT cannot guarantee absolute security. Users and customers are responsible for safeguarding credentials, configuring permissions appropriately, and using the Services in a secure manner.

12. International Transfers

JTT may store and process personal information in the United States and other jurisdictions where JTT, its affiliates, service providers, or infrastructure providers operate. If personal information is transferred across borders, JTT will take steps designed to provide an appropriate level of protection consistent with applicable law, which may include contractual commitments or other recognized transfer mechanisms where required. By using the Services where permitted by law, you understand that information may be transferred to countries that may have different data protection laws than the country in which you reside.

13. Your Privacy Rights and Choices

Depending on your location and applicable law, you may have rights relating to your personal information, such as the right to access, correct, delete, obtain a copy, limit certain processing, object to certain processing, withdraw consent where processing is based on consent, appeal a denial of a rights request, or opt out of targeted advertising, profiling, or certain sales or sharing activities where those concepts apply. We will not discriminate against you for exercising rights provided by law. To submit a request, you or your authorized agent may contact us using the information in the “Contact Us” section. If we process your information on behalf of a customer, we may direct you to that customer, and we may need to verify your identity before fulfilling a request.

14. Region-Specific Disclosures

Residents of certain jurisdictions, including California and other U.S. states with comprehensive privacy laws, may be entitled to additional disclosures regarding categories of personal information collected, sources, purposes, categories of recipients, retention considerations, and rights. Where applicable, JTT may provide supplemental state-specific or region-specific notices, including notices about sensitive personal information, advertising technologies, and rights request processes. To the extent required by law, those supplemental notices are incorporated into and form part of this Privacy Policy.

15. Children’s Privacy

The Services are intended for business use and are not directed to children. JTT does not knowingly collect personal information directly from children in violation of applicable law. If JTT learns that it has collected personal information from a child in a manner not permitted by law, JTT will take commercially reasonable steps to delete that information.

16. Third-Party Services

The Services may link to or integrate with third-party websites, applications, products, or services. This Privacy Policy does not apply to third-party services, and JTT is not responsible for their privacy practices. Users should review the privacy notices and terms of those third parties before providing information to them or enabling integrations.

17. Changes to this Privacy Policy

JTT may update this Privacy Policy from time to time to reflect changes in law, regulation, technology, business operations, or the Services. When required by law, we will provide notice of material changes through the Services, by email, or by other appropriate means. The “Last Updated” date at the top of this Privacy Policy indicates when the most recent revision became effective. Continued use of the Services after the effective date of an updated Privacy Policy is subject to the revised policy to the extent permitted by law.

JTT may also designate a specific privacy email address, webform, or mailing address for rights requests, regulatory inquiries, and complaints. Customers with contractual privacy questions, security reviews, or data processing addendum requests should contact their account representative or legal contact listed in the applicable agreement.
